Need Help! Problem Gardening in my own Backyard

HOA’s are a legal disaster that Lawyer’s feed on, that is why they exist the way they are written. Enforcement is another thing, at least here there is a third party management company vs. a bunch of Yahoo neighbor’s “BOD”, but regardless the Management Company probably does not understand the laws surround this or how to enforce them. I’ve have read them in state from being in litigation with a BOD over a approved shed and driveway I deviated from and parked trailer that became a power struggle, next one I bought into I became President…Can’t beat em join em…haha!

I believe they quoted an article out of the Declaration or not By-Laws, and it sounds like there was a deviation to the original bought off plan that encroaches on the master drainage plan. Most of these member plans I have seen are approved by a “HOA Design Committee” that has a common landscape plan, not neighbors although part of that process may involve directly affect neighbor’s opinions.

Listen to this advice close, you don’t want to get into litigation with these yahoo’s, although there probably are little funds available for litigation it will drag on and on for all parties involved starting next w/a letter from their attorney, then you will have to hire one to respond and possible go to court. Only one that wins are the attorneys, not the HOA and your house value since that is money that could have been better spent. I’d submit a new plan or go back to the original, create peace, or it’s going to cost.

Other thing you can look at if you want to fight is usually a majority vote overides the BOD check your by-laws. You would have to go door-to-door show pics, explain, etc. I tried that but found alot of people don’t want to get involved too afraid of being picked on.

SD IRA help

A 401k is employer sponsored. There is no requirement that the employer be an LLC or corporation. The employer could be as simple as your sole-proprietorship which pays you the income it makes lending money or buying tax liens. This is true with or without checkbook access to an SD401k. I think this responds to Jon’s comment.

Jeff S and Bryan Hancock: So, if I understand correctly, I could take IRA funds or funds in a previous employer’s 401k, and roll them into a solo 401k. Then I create a company and have the solo401k invest the money into that company. (May have things out of order here.) Then company then makes loans, buys tax liens, flips houses, or whatever. That (hopefully) generates some income. I pay that income back to myself as a salary. The income comes to me, not back into the solo 401k. Did I understand that correctly? That’s passes IRS scrutiny and isn’t self-dealing?

HELP!! Can’t sell my beautuful flip becasue of house next door.

Rob, I know what you are saying, I just don’t think a residential neighborhood is a place for them to be conducting a business like this espcially if it effects your neighbors. There are deed restriction to protect the neighborhood and property values. They can lease a commmercial property or unrestricted property for that purpose. I also found out that the house is being leased to them and the owner has been notified before about the violations and he does nothing about it. Obviously he is making money and sees nothging wrong with it. I also talked to the owner across the street who just had a lease broken only after few months, people didn’t feel comfortable living there with small kids is what he was told.

–By the way does any one know how I can fix my post headline? it was late at night and I screwed it up pretty well–

Need advice on selling first wholesale deal. HELP

Hi Larry,

If all your numbers are accurate (and what the hey, I’ll just assume they are), that’s a pretty hot deal. I would have no trouble asking (and getting) 93-95k here in my area.

I would ask a little higher, then begin reducing your price if you’re not getting the offers you should. Make your headline on Craigslist “Price Reduced!!” What are the average days on market for that area? That will play heavily into your buyer’s plan. Lakefront property doesn’t always move fast around here.

Loan Needed (NEED HELP!!) – Residential Hard/Private $ in CA – Small Loan amt

Hi all,

Usually I’m able to place most loans, however, I could use the help if someone out there has $ for this scenario:

62K Purchase in San Jacinto, CA

~22K to the table

~40K loan amount

Credit is ok – 660s

I only have 1 group who will go this low, and they want 45% down. Please advise if can help, refer, or advice, otherwise I will tell the borrower to save some more $ and wait. Thanks.
